1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Theo mobile application (the "App"), operated by Theo ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

We reserve the right to change or modify these Terms at any time. We will notify you of any material changes by updating the "Last updated" date and posting the revised Terms. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

If you are under 18 years old, you must have permission from a parent or legal guardian to use the App and purchase subscriptions.

3. Account Registration and Security

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if we suspect any unauthorized use or security breach.

4. Subscriptions and Payments

4.1 Subscription Plans

Theo offers premium features through paid subscription plans:

  • Monthly Plan: $X.XX per month
  • Annual Plan: $X.XX per year

Pricing is subject to change with notice. Changes will not affect your current subscription period.

4.2 Free Trial

We offer a 7-day free trial for first-time subscribers. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin, and you will be charged the applicable subscription fee.

Important: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that publication.

4.3 Payment Processing

All payments are processed through your Apple ID account and are subject to Apple's payment terms. We do not have access to your payment information.

4.4 Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected subscription plan.

The renewal cost will be the same as the original subscription price unless you are notified otherwise in advance.

4.5 Managing Your Subscription

You may manage your subscription and turn off auto-renewal at any time by following these steps:

  1. Open the Settings app on your iOS device
  2. Tap your name at the top of the screen
  3. Tap Subscriptions
  4. Tap Theo
  5. Use the options to manage or cancel your subscription

You can also manage subscriptions through the App Store app on your device.

4.6 Cancellation

You may cancel your subscription at any time. To avoid being charged for the next billing period, you must cancel at least 24 hours before the end of the current period.

Cancellation takes effect at the end of your current billing period. You will continue to have access to premium features until the end of the period you have paid for.

4.7 Refunds

All sales are final. Refunds are handled exclusively by Apple in accordance with Apple's refund policy.

To request a refund, you must contact Apple directly:

We cannot process refund requests directly. All refund decisions are at Apple's sole discretion.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates any applicable federal, state, local, or international law or regulation
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the App
  • Impersonate or attempt to impersonate the Company, another user, or any other person or entity
  • Use the App to transmit, or procure the sending of, any advertising or promotional material without our prior written consent
  • Interfere with or disrupt the App or servers or networks connected to the App
  • Attempt to gain unauthorized access to any portion of the App or any other systems or networks
  • Use any automated system, including but not limited to "robots," "spiders," or "scrapers" to access the App
  • Reverse engineer, decompile, or disassemble any software contained in the App
  • Remove or modify any copyright, trademark, or other proprietary rights notices

6. Intellectual Property Rights

6.1 Our Content

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof) are owned by Theo, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use, subject to these Terms.

6.3 Your Content

You retain all rights to the questions and content you submit to the App. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the App's services.

6.4 Trademarks

The Theo name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Theo. You may not use such marks without our prior written permission.

7. AI-Generated Content Disclaimer

Important Notice: Responses provided by the App are generated by artificial intelligence technology and attributed to historical theologians. These responses:

  • Are AI interpretations based on trained models, not actual responses from the theologians
  • May contain errors, inaccuracies, or limitations inherent in AI systems
  • Should not be considered professional theological, spiritual, religious, legal, or medical advice
  • Are provided for informational and educational purposes only
  • Do not represent the official positions or complete teachings of the theologians

You acknowledge that AI-generated content may be inaccurate or incomplete. We make no warranties regarding the accuracy, reliability, or completeness of any responses.

For authoritative theological guidance, we recommend consulting primary sources, qualified religious leaders, or professional advisors.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
  • WARRANTIES THAT DEFECTS WILL BE CORRECTED

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THEO, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, REVENUE, DATA, OR USE
  • ANY LOSS OR DAMAGE ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP
  • ANY ERRORS OR OMISSIONS IN CONTENT
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR YOUR PERSONAL INFORMATION

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Theo and its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the App
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

11. Termination

11.1 Termination by You

You may terminate your account at any time by:

  • Opening the App
  • Going to Settings > Account > Delete Account
  • Confirming the deletion

You should also cancel your subscription separately to avoid future charges (see Section 4.6).

11.2 Termination by Us

We may suspend or terminate your access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Fraudulent or illegal activity
  • Requests by law enforcement or government agencies
  • Extended periods of inactivity
  • Technical or security issues

11.3 Effect of Termination

Upon termination:

  • Your right to use the App will immediately cease
  • All licenses granted to you will terminate
  • We may delete your account and data in accordance with our Privacy Policy
  • Provisions that by their nature should survive termination shall survive (including intellectual property rights, disclaimers, limitation of liability, and dispute resolution)

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms and your use of the App are governed by and construed in accordance with the laws of the State of [STATE], United States, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the App.

12.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Theo regarding the App and supersede all prior agreements and understandings.

13.2 Waiver and Severability

Our failure to enforce any right or provision of these Terms will not be considered a waiver. If any provision is found to be unenforceable, the remaining provisions will remain in effect.

13.3 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

13.4 Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, government action, or technical failures.

13.5 Export Controls

The App may be subject to U.S. export control laws. You agree to comply with all applicable export and re-export control laws and regulations.

14. Apple App Store Additional Terms

If you access the App through the Apple App Store, the following additional terms apply:

  • These Terms are between you and Theo only, not with Apple
  • Your use of the App must comply with the App Store Terms of Service
  • Apple has no obligation to provide any maintenance or support services for the App
  • Apple is not responsible for any claims relating to the App or your use of it
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App
  • Apple is a third-party beneficiary of these Terms and has the right to enforce these Terms against you
